NXT ERA Financial Terms of Service

1. Who these terms apply to

The NXT ERA Financial platform (“NXT ERA Financial,” the “Platform,” “we,” “us”) is operated and developed by RJ Webworks LLC. These Terms of Service (“Terms”) govern your access to and use of the Platform.

The Platform may be used only by licensed life insurance agents (“Agents,” “you”). By creating an account you represent that you hold an active life insurance license in every state in which you contact or sell to a consumer through the Platform, that you are at least 18 years old, and that you are authorized to accept these Terms. You may not take a call from, or contact, a consumer in a state where you are not licensed.

You must keep your license active while you use the Platform and tell us promptly if it lapses, is suspended or is revoked. We may ask for proof of licensure at any time, and may suspend or close an account that cannot provide it.

By checking the agreement box during sign up, you confirm that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not agree, do not use the Platform.

2. Prepaid credits

The Platform runs on prepaid credits. You add credits to your own balance, and you spend them on what you use. There is no weekly plan, subscription or minimum. Your balance, and every credit added or spent, is shown in your dashboard and in your monthly statements.

Credits pay for:

• inbound calls, at the price of the call option you choose when you go available (currently $45 for Standard or $70 for New Policy). Every call you take while on an option is charged at that option's price, whichever kind of caller it is. A call is billed once it passes thirty seconds of talk time; shorter calls are free. If you call back a caller whose call was not billed and that callback passes thirty seconds, the original call is billed at its price instead — a call is never billed more than once. A caller's phone number is shown to you once their call is billable;
• leads bought in the Lead Store, at the price shown when you order. You are charged only for the leads actually delivered;
• real-time orders, which are paid in full when placed. If you stop an order, or it ends before it is filled, the undelivered part is credited back to your balance.

Credits do not expire. Credits spent on calls and leads that were delivered are final and non-refundable, whatever the outcome of the call or lead. Unspent credits are not redeemable for cash and are not refundable except at our discretion. Prices may change; a change applies to calls and orders after it takes effect, never to credits already spent.

How calls are routed. Calls are routed by the state associated with the caller's phone number: first to a free agent licensed in that state; if none is free, to licensed agents as they become free, for a short time; and then, so no call is dropped, to whichever agent is free first. A caller's phone number may not reflect where they live. New Policy describes how our call providers classify the traffic they send; it is not a guarantee of any caller's intent, the quality of any call, or any result. You must keep the states listed on your account accurate: only list states where you hold an active license, and only take calls from consumers in states where you are licensed. You can add states at any time; to remove one, contact us through Help & Bugs.

All calls are recorded. Every call on the Platform is recorded, including inbound calls, callbacks, and anyone you add to a call. Callers hear a recording notice before they are connected to you; when you add someone to a call (for example, an insurance carrier), you must tell them the call is recorded. Recordings are kept for compliance, quality assurance, training and dispute resolution, may be used to review a dispute or a complaint, and can be accessed only by RJ Webworks LLC. By using the Platform you consent to your calls being recorded.

Figures such as projected calls, deals, return, and annual premium are estimates. Actual results vary and are sometimes outside our control.

3. Paying by card

You add credits by card, Apple Pay, Google Pay or Link, processed by Stripe. A 3% card processing fee is added to each top-up and shown to you before you pay: adding $1,000 of credits charges $1,030. Credits appear on your balance as soon as the payment is confirmed.

If you save a card, you authorise us to charge it for top-ups you request, and for auto-reload according to the rule you set (for example, “add $500 when my balance falls below $100”), until you turn auto-reload off or remove the card. You can do either at any time in your settings.

4. No disputes or chargebacks

By accepting these Terms and adding credits, you agree not to initiate, file, or pursue any payment dispute, chargeback, reversal, or bank/card complaint against any payment made to NXT ERA Financial or RJ Webworks LLC.

You agree that any billing question or concern will be raised and resolved exclusively through the channels described in Section 12 before any other action is taken. Filing a chargeback or dispute is a material breach of these Terms.

You specifically acknowledge that a top-up buys credits, delivered to your balance immediately on confirmation of payment, and that calls and leads paid for with those credits are services delivered when you receive them — regardless of your results. Volume, quality and conversion are not guaranteed anywhere in these Terms. A dispute or chargeback filed on the basis of poor results or dissatisfaction is a dispute about a service that was in fact delivered.

Your acceptance of these Terms, each payment and its amount, the credits added, and every call and lead charged to your balance are recorded, and may be provided to a card issuer, bank or processor in response to a dispute.

To the fullest extent permitted by law, the managers, members, officers, employees, and agents of NXT ERA Financial and RJ Webworks LLC are not liable for any chargebacks, disputes, reversals, or related fees or losses. You agree to reimburse us for any costs, fees, or losses we incur as a result of a chargeback or dispute you initiate in violation of these Terms.

5. Honest conduct — no fraud or misrepresentation

You agree to act honestly, lawfully, and in good faith at all times. Specifically, you agree that you will not:

• commit fraud, or make any false, misleading, or deceptive statement of fact to any caller, customer, carrier, or regulator on the phone system;
• enter false, misleading, inaccurate, or fabricated information into this system (including call dispositions, premiums, customer details, or production data);
• misrepresent your identity, license status, the products you offer, or your authority to sell them;
• claim to be, or to be calling from, an insurance carrier or a government agency. You may not say, for example, that you are Mutual of Omaha, or that you are with Veterans Affairs, Medicare or Social Security. You may say who you actually are: a licensed agent or broker who is appointed with, or offers products from, a carrier — for example, “I'm a licensed agent, and one of the carriers I work with is Mutual of Omaha”;
• violate any applicable law or regulation, including Medicare / CMS marketing and enrollment rules, state insurance regulations, TCPA, and Do-Not-Call requirements.

You are solely responsible for your own compliance with all laws and carrier guidelines applicable to your insurance sales.

6. Your leads — what you get

When you buy leads on the Platform, you are buying access to those consumer contact records. Leads you buy, and leads you add yourself, make up your book.

We make no guarantee of quality, contact rate, or conversion. You are charged only for the leads actually delivered to you. Nothing in these Terms promises a number of conversations or any sale.

You may export your leads at any time, and you may keep and continue to work them after you stop using the Platform, including after your account is closed. Once a lead leaves the Platform, how you store, secure and use it is your responsibility, and Section 7 applies to every contact you make with it, on or off the Platform.

You may not sell, rent, trade, or give purchased leads to anyone else. Your access is for your own insurance sales.

7. Contacting leads — compliance is yours

A lead is a real person who filled in an advertisement form. When you contact them, you are the caller and the legal responsibility is yours. That includes, without limitation: the Telephone Consumer Protection Act, state calling-hour restrictions, state and federal Do Not Call registry scrubbing, your licensing in the consumer’s state, and identifying yourself and your agency truthfully on every call.

If a consumer asks not to be contacted again, you must mark them “do not call” in the Platform. This is not optional. Doing so permanently blocks that phone number and email address across the entire Platform, for every agency, and prevents the record from ever being reassigned. It can only be undone by RJ Webworks LLC, and only where there is a compelling reason.

Any SMS or email you send through the Platform in future is subject to the same consent requirements, and to any additional rules we publish for those channels.

You will indemnify NXT ERA Financial and RJ Webworks LLC against any claim, penalty, or cost arising from how you contacted a lead.

8. Your leads are yours

Leads you buy and leads you add are yours. They are never reclaimed or reassigned, whatever their status and however long you keep them, for as long as your account is open.

Your agency’s owner may export reclaimed leads out of the Platform. Once exported, the owner remains bound by the same compliance and deletion obligations that applied inside it, including honouring a consumer deletion request against their copy. Every export is recorded.

9. Termination

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms. If you are found to have lied, committed fraud, entered false information, or otherwise misrepresented facts on the phone system or in this system, your account may be terminated immediately.

Termination for any reason does not entitle you to any refund. All amounts paid remain non-refundable as described in Section 2.

10. Disclaimers & limitation of liability

The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free service, any specific volume or quality of calls, or any specific earnings or results.

To the maximum extent permitted by law, in no event will NXT ERA Financial, RJ Webworks LLC, or their managers, members, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenue. Our total aggregate liability for any claim relating to the Platform will not exceed the amount you paid to us in the one (1) month preceding the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

12. Contact & proper channels

Any question, concern, billing matter, or dispute must first be submitted to us through the proper channels before any other action.
